Protecting your privacy is important to us

Injury Lawyers 4U Limited (“IL4U”) is a not-for-profit organisation comprised of a marketing consortium made up of firms of Solicitors who are members of IL4U (Panel Members).

To be able to provide a service to you, IL4U must collect and process personal data from you and share your personal data with other parties.

In respect of your personal data, IL4U acts as a Data Controller within the definition of the UK General Data Protection comprising Regulation (EU) 2016/679 and Data Protection Act 2018, hereafter UK GDPR.

This Privacy Notice explains what personal data IL4U collects from you or about you, how that information is collected and processed and for what purpose and the lawful basis on which the processing of your personal data is conducted. This notice also explains your rights in respect of any of your personal data being processed by IL4U.

What personal data do we process?

To assist in connecting you to a Panel Member to deal with your enquiry, it is necessary to collect and process your personal data including but not limited to the following categories of data:

  • Name, Address and contact information;
  • Health data (only if provided by you on enquiry);
  • IP address, browser, device and platform data.

There may be additional information we require relating to you however we will only collect information from you that we feel is necessary for the purposes identified below. If you do not wish to provide data when requested, we will advise whether you have a statutory obligation to provide the data and of the consequences of not providing the data.

We will collect information directly from you and from third parties in the course of providing or considering the provision of our services to you.

Any additional information that you provide either when speaking to one of our Customer Service agents or by email or web contact form is not strictly necessary in order to place your enquiry with a Panel Member but will be entered into our database accordingly.

What do we use your data for?

Your personal data is collected and processed for the following purposes:

  • For responding to your enquiry and/or ascertaining whether you may have a legal claim and/or to allocate your enquiry to a Panel Member. IL4U will process your data in accordance with its legitimate interests to provide services to both you and its Panel Members.
  • To request your feedback, via review sites such as TrustPilot, on our services provided to you. We will do this on the basis that it is in IL4U’s legitimate interests to gather feedback from clients to further improve the service it provides.
  • We utlilise various cookies to enhance your experience across the IL4U website and for analysing visitor information in accordance with our legitimate interests. You will have been presented with the option to consent to all or selected non-essential cookies when arriving at the website and have the option to change those settings at any time. We only use tracking data for analysing marketing performance and improving website performance.
  • When calling one of the phone numbers shown on our website, any tracking data you have consented to may be shared with third party providers who allow telephone call events to be linked to visits to our website. This information is again only used for website optimisation and marketing performance analysis.
  • We will only process your personal data for the above outlined purposes. In the event that a new purpose of processing is proposed, we will only process your personal data where it is compatible with the original purposes for which we collected it, where you have given your explicit consent, or where we have an identifiable legal basis for doing so.

Sharing your personal data

We will only share your data where it is required in order to effectively offer or provide our services to you, where there are providers of services complementary to the services we provide from which you may benefit, where we are unable to assist but can put you in contact with alternative professional service providers that may be able to offer services, where there is a legal obligation by which we are bound or where otherwise necessary. The following are common recipients or categories of recipients that we may share your data with:

  • A telephone answering service selected by IL4U and acting as agents for IL4U for the purpose of processing your enquiry as to whether you have a legal claim and/or responding to any other such enquiry you make with IL4U;
  • An organisation selected by IL4U to provide support services comprised of customer service and/or administrative services on behalf of IL4U;
  • An IL4U member or members for the purpose of processing your enquiry as to whether you have a legal claim in respect of which the IL4U member is willing to act on your behalf and/or responding to any other such enquiry you make with IL4U;
  • Review sites such as TrustPilot to allow for review invitations to be sent to you via e-mail;
  • There are also organisations who will have access to your data due to the services they provide to IL4U such as IT support companies, email and phone service providers and external auditors. While we may not actively share your specific data with these firms, we will ensure that when providing access to any data systems, the security of that data is considered and protected at all times.

Transfer of your personal data to any third countries or international organisations

IL4U will not transfer your personal data to any countries outside of the United Kingdom.

How long will we keep your data?

IL4U will retain information in relation to your enquiry for the following periods:

  • Call recordings – a period not exceeding twelve months from the date of your call;
  • Electronic files comprised of IL4U’s records pertaining to your enquiry – for a period not exceeding seven years from the date of your initial enquiry.

Your data protection rights

Under the terms of data protection legislation, you have the following rights:

  • You have the right to ask us what personal data we are processing about you and request access to or copies of that information.
  • You have the right to request that your personal data which is inaccurate or incomplete is rectified.
  • You have the right to request that your personal data is deleted, however we may have the right to continue processing your data in certain circumstances.
  • You have the right to request that your data is given to you in a format that can be used by another controller and where possible that this is sent directly to the other controller by us.
  • Where the processing relies upon your consent or if you are under 18 the consent of an adult bringing the claim on your behalf then the person giving consent has the right to withdraw this at any time.
  • You have the right to object to the processing of your data where the grounds we rely upon are our legitimate interests or the legitimate interests of a third party. Upon receiving an expression of objection, we will review the grounds for processing and respond accordingly. Where we are processing for direct marketing purposes you have the right to object at any time and we will cease processing for such purposes where an objection is received.
  • You have the right not to be subject to automated decision-making processes having legal or similarly significant effects on you including profiling. Please note however IL4U does not employ any automated decision-making processes which may have these effects.
  • You have the right to restrict the processing of your personal data:
  1. Where the accuracy is contested while this is investigated;
  2. Where the processing is unlawful, but you do not want the data to be deleted;
  3. Where we no longer need to process the data, but you would like us to store it without further processing for the establishment, exercise or defence of legal claims;
  4. Where you have objected to the processing and we are processing for our legitimate interests while it is established if our interests override your rights.

We will respond to your request in relation to any of the above rights within one month of us receiving your request unless there is likely to be a delay providing the information or response, in which case we will notify you within one month of receiving the request. There will be no fee payable for us to provide you with the information requested unless the request is for duplicate copies of documents previously provided to you or we feel the request is manifestly unfounded or excessive. If a request is manifestly unfounded or excessive we may refuse to provide the data rather than charging a fee. Where a fee is charged it will reflect the administrative costs involved in providing you with the information.

We may require identification from you for security purposes before providing any information or acting on requests. Where this is required we will notify you within one month of receipt of your request.
Where you make a request to us electronically we will endeavour to respond electronically. If you would prefer not to receive the information electronically you should request this.

If we are unable to comply with your request, we will inform you within one month of receipt of your request providing the reasons and advising you of your options to escalate the matter further.

You have the right to lodge a complaint with the Information Commissioners Office who regulate Data Protection compliance in the UK if you are not satisfied with any response provided by IL4U in relation to the exercise of your rights under the relevant English Data Protection law.

Changes to this Privacy Policy

This Privacy Notice will be reviewed and updated in line with changes to data protection laws and internal policy.
